3Eligibility

4.2 What You May Do

• Reposting Gladewick articles to AI training datasets, content aggregators, or content databases without written authorization
• Modifying, adapting, translating, or creating derivative works based on Gladewick content without written permission
• Removing, altering, or obscuring any copyright notices, author credits, or proprietary notices from Gladewick content
• Using the Gladewick name, logo, or brand assets in any manner that implies affiliation, endorsement, or partnership without written authorization
• Framing or using in-line linking to display Gladewick content on another website without permission
• Using Gladewick content for any commercial purpose without a separate written license agreement

5Permitted Use of the Site

Subject to your compliance with these Terms, Gladewick grants you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your own personal, non-commercial informational purposes.

This license does not include the right to:

• Resell or commercially exploit any content, products, or services obtained through the Site
• Make any derivative use of the Site or its content
• Download or copy account information for the benefit of another merchant

Violation of any of the above may result in termination of your access to the Site, referral to law enforcement, legal action, or all of the above.

7User-Submitted Content

7.1 Your Representations

By submitting any content to Gladewick, you represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to submit the content

• The content does not contain material that is defamatory, obscene, threatening, harassing, or otherwise unlawful

7.2 License Grant to Gladewick

By submitting content to Gladewick (including via email, contact forms, or contributor submissions), you grant Gladewick a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, edit, and publish that content in connection with our editorial operations, including for the purpose of responding to your inquiry or incorporating your contribution into our content.

Gladewick does not claim ownership of content you submit. This license is limited to the purposes described above and does not allow Gladewick to sell your content or use it in ways unrelated to operating the Site.

7.3 No Obligation to Publish

Gladewick has no obligation to publish, respond to, or retain any content you submit. We reserve the right to remove, edit, or decline any submitted content at our sole discretion, without notice.

8Editorial Disclaimer & Accuracy of Content

Gladewick publishes home and garden content for informational and educational purposes only. While we maintain rigorous editorial standards — including expert authorship and independent peer review — the content on this Site is not a substitute for professional advice from a licensed contractor, architect, interior designer, landscape professional, electrician, plumber, or any other credentialed trade or design professional.

11Disclaimer of Warranties

14DMCA & Copyright Infringement

If you believe content was removed from the Site as a result of a mistake or misidentification, you may submit a counter-notification to our copyright agent at the address above. Your counter-notification must comply with the requirements of 17 U.S.C. § 512(g)(3).

15Governing Law

These Terms and any dispute arising out of or related to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the United States of America, without regard to its conflict of law provisions.

To the extent that any dispute is subject to state law, it shall be governed by the laws of the state in which Gladewick is principally operated, without giving effect to any choice of law or conflict of law rules.

You agree that any legal action or proceeding between you and Gladewick arising from or relating to these Terms shall be brought exclusively in the applicable federal or state courts of the United States, and you hereby consent to the personal jurisdiction and venue of such courts.

16Dispute Resolution

We hope that any concerns you have can be resolved informally. Before initiating any formal dispute resolution, you agree to first contact Gladewick at hello@gladewick.com with a written description of your dispute and the relief you are seeking. Gladewick will attempt to resolve your concern within 30 days of receipt.

16.1 Informal Resolution

Most concerns can be resolved quickly and without formal proceedings. Please email us before escalating any dispute, as we are committed to resolving issues fairly and efficiently.

16.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Site that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. This arbitration provision applies to the maximum extent permitted by law.

16.3 Class Action Waiver

You agree that any arbitration shall be conducted solely on an individual basis and not as a class, collective, consolidated, or representative action. You waive the right to participate in any class action lawsuit or class-wide arbitration against Gladewick.

16.4 Exceptions to Arbitration

Notwithstanding the above, either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm, including to protect intellectual property rights, pending completion of arbitration. Nothing in this section prevents either party from seeking provisional remedies in court.

17Termination

Gladewick reserves the right, at its sole discretion, to restrict, suspend, or terminate your access to all or any part of the Site, at any time and without notice, for any reason, including but not limited to:

• Violation of any provision of these Terms
• Conduct that Gladewick determines, in its sole discretion, to be harmful to other users, third parties, the Site, or Gladewick’s reputation or business interests
• Any conduct that violates applicable law or regulation
• Technical, legal, or operational reasons at Gladewick’s discretion

Upon termination, your right to use the Site ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 4 (Intellectual Property), 8 (Editorial Disclaimer), 11 (Disclaimer of Warranties), 12 (Limitation of Liability), 13 (Indemnification), 15 (Governing Law), and 16 (Dispute Resolution).

18Changes to These Terms

Gladewick reserves the right to modify these Terms at any time. When we make material changes, we will:

• Post a notice on the Gladewick homepage for at least 30 days following any material change
• Notify newsletter subscribers by email for changes that materially affect their rights
